Overview
SEAPA is applying for a Non-Capacity Amendment of License to modify the FERC Project boundary to exclude the transmission line, extending from the switchyard adjacent to the powerhouse 79.5 miles northwest to the Petersburg switchyard.
Since SEAPA constructed the Swan-Tyee Intertie in 2009, connecting the Tyee Lake Project to the rest of SEAPA’s generation system at the point of the switchyard adjacent to the powerhouse, the transmission line no longer fits the definition of a primary transmission line pursuant to the Federal Power Act (FPA) Section 3(11).
The proposed change in the FERC Project boundary would not result in any change in ownership, right-of-way permits, or changes to normal operation and maintenance of the transmission line.
In similar proceedings, FERC has determined that any order amending the license to remove from the project boundary a non-primary transmission line, over which FERC has no jurisdiction, would be a non-discretionary, ministerial action. Accordingly, SEAPA seeks ministerial changes to License Article 33 to remove 1,174 acres of federal land subject to annual fees.
For the amendment application process, SEAPA distributed a draft amendment application on April 1, 2026 to regulatory agencies and other stakeholders for a 60-day comment period. Following the comment period, SEAPA will address comments and file a final version of the application with FERC.
